1. Service provider

Transport services ordered on expressmarli.com are performed and invoiced by Marli sp. z o.o., a company incorporated under Polish law, NIP 9571086235, ul. Bergiela 2b/8, 80-180 Gdańsk, Poland (“Marli”). SARL Marli Express, 7 rue de Castellane, 75008 Paris, RCS Paris 927 542 183, acts as commercial representative in France. Contact: contact@expressmarli.com, +33 7 49 14 57 21.

2. Scope

These terms apply to every order for road transport of goods placed by a business customer. Placing an order implies full acceptance of these terms. Services are reserved for businesses holding a valid EU VAT number.

3. Orders and quotes

The price shown by the online calculator is an indicative quote based on the information provided by the customer (addresses, dimensions, weight, nature of the goods). The order becomes binding upon Marli’s written confirmation (e-mail). Marli may refuse an order, in particular in case of prohibited goods, inaccurate information or unavailability.

4. Prices and payment

Prices are quoted in euros, excluding VAT. The reverse-charge mechanism (0% VAT) applies to business customers established in the EU with a valid VAT number; otherwise the applicable VAT is added. The price includes 60 minutes for loading and unloading; each additional hour of waiting is charged at €30 net. Loading or unloading assistance by the driver is charged at €50 net per operation.

Invoices are payable within 14 days of the invoice date by bank transfer. Late payment automatically incurs interest at three times the French statutory rate and a fixed recovery fee of €40.

5. Customer obligations

  • provide accurate and complete information on the goods, addresses and time slots;
  • hand over goods properly packed, labelled and prepared for road transport;
  • ensure access to the loading and unloading sites at the agreed times;
  • not tender any goods listed as prohibited goods.

6. Performance

Pick-up and delivery times are indicative and depend on traffic, weather and customs conditions. Marli makes every effort to meet them but is not liable for delays due to force majeure or to an act of the customer or a third party. Marli may entrust all or part of the transport to a partner carrier under its own responsibility.

7. Liability

International transport is governed by the Convention on the Contract for the International Carriage of Goods by Road (CMR) of 19 May 1956. Domestic transport in France is governed by the applicable standard contract (Annex to Article D. 3222-1 of the French Transport Code). Unless a declaration of value has been accepted in writing before transport, Marli’s liability for loss or damage is limited to the ceilings set by those texts (8.33 SDR per kilogram of gross weight lost or damaged under CMR). Reservations must be noted on the consignment note on delivery and confirmed in writing within the statutory time limits.

8. Cancellation

Any cancellation must be notified in writing to contact@expressmarli.com. A cancellation made less than 2 hours before the agreed pick-up time, or after the vehicle has arrived at the loading site, is charged at 50% of the transport price. An empty journey caused by a customer error is charged at the same rate.

9. Personal data

Data collected when ordering is used to perform the contract and for invoicing, in accordance with our privacy policy.

10. Governing law and disputes

These terms are governed by Polish law, without prejudice to the mandatory provisions of the CMR Convention. In the event of a dispute the parties will seek an amicable solution; failing that, the courts of Gdańsk (Poland) have exclusive jurisdiction, subject to the mandatory jurisdiction rules of the CMR Convention.
